These terms apply to Peakline for iPhone and Android, and this website. Peakline is made by an independent developer in Hong Kong ("we", "us"). By downloading or using Peakline you agree to these terms. If you do not agree, please do not use it.

1. The app and store terms

On iPhone, Peakline is licensed to you through the App Store under Apple's Licensed Application End User License Agreement ("Apple's EULA"). These terms add to Apple's EULA; where the two differ about the licence of the app, Apple's EULA applies. We, not Apple, are responsible for Peakline and its content.

The Android version is distributed through Google Play, whose Terms of Service also apply to store use and purchases.

2. Purchases and subscriptions

• Exploring the map and your routes is free. Videos without the watermark are sold in the app: Peakline Pro (monthly or yearly), a single HD video, or a pass for one day or three days. Availability and prices are shown by your platform’s store before you buy.
• On iPhone, payment is charged to your Apple ID. Pro renews automatically at the end of each period unless you turn it off at least 24 hours before the period ends, in your Apple ID's subscription settings. A free trial, where offered, becomes a paid subscription when it ends unless cancelled before then.
• A single HD video is used up when the video is made. A pass lasts for its stated time from when you buy it.
• On Android, payment and subscription renewals use your Google Play account; manage cancellation in Google Play before the next renewal. Restore eligible purchases in the app’s Settings using the same platform and store account. Refunds are handled by the relevant store under its policies.
• We may change prices and what each purchase includes. A change in a subscription's price follows the relevant store’s rules for telling subscribers.

3. Your routes and videos

The GPX files you open and the videos you make are yours. You are responsible for having the right to use and share what you import and what you publish. Videos keep their credits for the map's data, as the data's terms require.

4. Fair use

Please do not copy, extract or resell the app's map data, attempt to remove its watermarks or credits from videos made during the free trial, reverse engineer the app except where the law allows it, or use Peakline to break the law.

5. Map data and outdoor safety

Peakline's map is drawn from open data published by the Government of the Hong Kong Special Administrative Region and from OpenStreetMap contributors, which may be incomplete, out of date or inaccurate. It is not an official map and is not a navigation aid.

Hiking and outdoor activities carry real risk. Do not rely on Peakline alone where your safety depends on it. Check the Hong Kong Observatory's weather and warnings, follow official trail advice, carry a proper map, and tell someone your route. You take part in any activity at your own risk.

6. Others' data and software

The data and open-source software that Peakline is built with belong to their owners and are used under their licences; the credits and licences are listed in the app's Settings.

7. No warranty

To the extent the law allows, Peakline is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose and accuracy of its data.

8. Limitation of liability

To the extent the law allows, we are not liable for any indirect, incidental or consequential loss, or for loss arising from reliance on the map's data, and our total liability for any claim relating to Peakline is limited to the amount you paid for it in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

9. Changes

We may update these terms. The new version will be posted on this page with its date; continuing to use Peakline after that means you accept it.

10. Law

These terms are governed by the laws of the Hong Kong Special Administrative Region, and its courts have jurisdiction over any dispute.
